These Terms of Service ("Terms") govern your access to and use of Capital Peptides (https://peptidessacramento.com) and any products supplied through this site. By using the site or purchasing products, you agree to these Terms. If you do not agree, do not use the site.

1. Research Use Only

All products sold by Capital Peptides are supplied strictly as laboratory reagents for in vitro research use only. Products are not drugs, not dietary supplements, and not cosmetics. They have not been approved by the FDA or any regulatory agency for any diagnostic, therapeutic, veterinary, or human use.

Products are not for human consumption, not for veterinary use, not for diagnostic use, and not for therapeutic use. Any other use is strictly prohibited and is made solely at the purchaser's own risk.

2. Eligibility & Researcher Representation

By purchasing or placing an order, you represent and warrant that:

• You are at least 21 years of age.
• You are a qualified researcher, research professional, or are purchasing on behalf of a research institution.
• You will use the products exclusively for laboratory research purposes.
• You will not administer, consume, or otherwise introduce the products into any human or animal body.
• You will handle, store, and dispose of the products in compliance with all applicable federal, state, and local laws and standard laboratory safety practices.

3. No Medical Claims

Capital Peptides makes no medical claims regarding any product. Nothing on the site — including product pages, articles, guides, the reconstitution calculator, the chat assistant, or any other content — constitutes medical advice, diagnosis, or treatment. Content is provided for informational and research reference purposes only. Always consult a licensed healthcare provider regarding any medical condition.

4. Products Sold "As-Is"; No Warranties of Fitness

All products are sold "as-is" and "with all faults" for research use. To the maximum extent permitted by law, Capital Peptides disclaims all warranties, express or implied, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.

Capital Peptides does not warrant that any product is fit for any specific research application, and does not warrant any particular result from the use of any product.

5. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Capital Peptides, its officers, directors, employees, affiliates, or suppliers be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages (including lost profits, lost data, or business interruption) arising out of or relating to the site, the products, or these Terms, even if Capital Peptides has been advised of the possibility of such damages.

In any event, Capital Peptides's aggregate liability to you arising out of or relating to the site or the products shall not exceed the amount you paid to Capital Peptides for the product giving rise to the claim in the twelve (12) months preceding the claim.

6. Indemnification

You agree to indemnify, defend, and hold harmless Capital Peptides and its affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use or misuse of any product; (b) your breach of these Terms; (c) your violation of any law or the rights of any third party; or (d) any use of a product other than strictly for in vitro research.

7. Intellectual Property

All content on the site — including text, images, logos, the reconstitution calculator, and software — is owned by or licensed to Capital Peptides and is protected by copyright, trademark, and other intellectual-property laws. You may not copy, reproduce, or create derivative works without prior written permission, except for personal, non-commercial browsing.

8. Account & Order Accuracy

You are responsible for providing accurate account, shipping, and payment information, and for maintaining the confidentiality of any account credentials. Capital Peptides reserves the right to refuse or cancel any order for any reason, including suspected misrepresentation, pricing errors, or inventory issues.

9. Governing Law

These Terms and any dispute arising out of or relating to them or the site are governed by the laws of the State of California, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

10. Dispute Resolution — Binding Arbitration

Except for claims that may be brought in small-claims court, any dispute, claim, or controversy arising out of or relating to these Terms, the site, or the products shall be resolved by binding individual arbitration administered by JAMS or the American Arbitration Association under its then-current consumer arbitration rules. The arbitration shall take place in Sacramento County, California, unless otherwise agreed.

Class-action waiver: You and Capital Peptides each waive any right to bring or participate in a class, collective, or representative action. Arbitration shall proceed on an individual basis only.

You may opt out of this arbitration provision by sending written notice to amgmpro@gmail.com within 30 days of first accepting these Terms.

11. Changes to These Terms

Capital Peptides may update these Terms at any time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the site after changes take effect constitutes acceptance of the revised Terms.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
